Copsemark terms of use
One payment, no subscription, and the professional judgement stays yours.

Copsemark is preparing for its first App Store release. The licence and access model below describes that planned release; it is not a statement that the app or hosted portal is already publicly released. The final price will appear in the app before purchase.
1. Who we are
Copsemark is made by Leon Figueira, trading as Puff Labs, in the United Kingdom. Contact: leonfigueira@gmail.com.
2. What you are buying
The app is free to download. One payment unlocks the finished outputs permanently: the DXF overlay and plan sheet, the PDF plan, the tree schedule, the impact assessment table and the written report, for as many surveys as you like. It is a licence to use the software, not a sale of the software itself.
There is no subscription and no renewal. The purchase is tied to your Apple Account and works on your iPads.
3. The free trial
Before you buy, you can run a 21-day trial that costs nothing. Its length is stated in the app before it starts, along with what stops working when it ends and what the app costs afterwards.
When the trial ends, nothing you have made is taken away. The app keeps opening, every survey keeps opening, you can keep recording and editing trees, the checker keeps working, and you can still export a CSV of your own data. What stops is the finished paperwork: the drawings, the schedule, the impact table and the report. We think a tool that held a consultant's own survey hostage would deserve to fail.
4. When the standard is reissued
If a new edition of BS 5837 requires a separate software edition, rewriting Copsemark is a substantial piece of work, so that edition may be offered as a separate purchase. What you have already bought is not affected: every survey you have done stays open, and Copsemark keeps producing the 2012 outputs for it, which is what a planning authority working to the 2012 edition asked you for.
5. The judgement is yours
This is the most important clause here, and it is not boilerplate.
Copsemark records what you measure, calculates what follows arithmetically from it, and draws it. It does not survey trees, it does not assess them, and it does not form an opinion. Retention categories, condition, remaining contribution, the effect of a scheme and every recommendation are yours. Where the app cannot know something, it says so and leaves the space for you to write in rather than filling it with a guess.
You are the arboriculturalist. You check the outputs before you issue them, you sign them, and you remain responsible for them and for your own professional indemnity. Nothing the app produces is advice from us, and the app is not a substitute for reading BS 5837 or for the judgement you are paid for.
6. What we do not promise
We work to make the outputs accurate and test the software and generated documents. We cannot promise that any planning authority, case officer or inspector will accept a particular submission: that decision is theirs and turns on the survey and the scheme, not on the software.
The app is provided as it is. To the extent the law allows, we exclude implied warranties. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our total liability to you is limited to what you paid for the app.
Copsemark is sold for use in a business, so the consumer rights that apply to consumer contracts may not apply to you. Whatever your status, nothing here affects rights you have that cannot be excluded by agreement, including your statutory rights if you are a consumer.
7. The standard itself
BS 5837:2012 is published by BSI and is their copyright. Copsemark does not reproduce it and does not replace it. Where the app paraphrases a clause it says so and names the clause, so you can read the source. You need your own access to the standard.
8. Base plans and other people's drawings
When you import a client's topographical survey or an architect's layout, you are responsible for having the right to use it for the purpose you are using it for. Copsemark draws on those base plans under your licence and prints an acknowledgement on the sheet. It does not re-issue anybody's base drawing as a separate file.
9. Refunds
Purchases are made through the App Store, so refunds are handled by Apple, not by us. Apple's process is at reportaproblem.apple.com. If something is wrong with the app, please tell us as well: we would rather fix it.
10. Acceptable use
Do not decompile, resell or redistribute the app, and do not try to circumvent the licence. Beyond that, use it for as many jobs and as many clients as you like: there is no per-survey or per-client limit on the local survey workflow. Online portal storage and service limits, if offered, are separate and must be shown before you use those services.
11. Changes to these terms
If these terms change, the date at the top changes with them. Changes apply to your continued use of the app; they do not take away a licence you have already bought.
12. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
